E-Reserve Copyright and Fair Use Information

Articles, book chapters, on-line materials, and websites as well as other materials are made available through IUP’s reserve in the library. It is the faculty, staff, and GA’s responsibility to make sure that the items placed on Reserve fall under fair use as explained in Title 17, Section 107 of the Copyright Law of the United States.

The easiest way to determine if an item falls under fair use is to use the Checklist for Fair Use. Please see Fair Use Descriptions for additional information. Each professor will be required to sign a copy of the Checklist for Fair Use that will be kept on file at the library. If the item(s) do not fall under fair use, copyright permission must be obtained before it is put on Reserve. The Reserve staff will not place any materials on line that do not have the appropriate citation information listed on the submission form at the time it is submitted. Likewise, if the Reserve staff feels that an item does not meet fair use requirements, you will be contacted regarding that item.

The copyright law of the United States (Title 17, United States Code) governs the making of photocopies or other reproductions of copyrighted materials. Under certain conditions specified in the law, libraries and archives are authorized to furnish a photocopy or other reproduction. One of these specified conditions is that the photocopy or reproduction is not to be used for any purpose other than private study, scholarship, or research. If a user makes a request for, or later uses, a photocopy or reproduction for purposes in excess of fair use, that user may be liable for copyright infringement.
