Background Check Policy Important Information

IUP is currently the subject of an audit by the Commonwealth Auditor General. The auditor will evaluate whether the university has appropriate systems in place to protect minor children who visit the university to participate in camps and conferences. The university is working to put systems in place that are meaningful and effective.

Any system needs to have three components:

  1. background checks;
  2. training to be able to identify signs of abuse; and
  3. a reporting protocol if abuse is suspected.

The purpose of this notification is to address the issue of background checks. The three required background checks are:

  1. Act 34 – Pennsylvania State Criminal History Record: This is to confirm whether or not an individual has a criminal record. This clearance is performed by the Pennsylvania State Police.
  2. Act 151 – PA Department of Public Welfare Child Abuse History Clearance: This clearance includes a review of a national database for any history of child abuse by an individual.
  3. Act 114 – Federal Criminal History Record Information (CHRI): The Pennsylvania Department of Education website provides detailed information about fingerprinting.

This summer, the university is developing protocols to enable its compliance with three background checks for student employees and volunteers involved in the delivery of conferences, camps, clinics, workshops, seminars, and residential programs which may include minors as participants. Given that Pennsylvania laws may be changing, IUP is aware that, even as protocols are designed for compliance, the university may be compelled to modify them.

IUP plans to have a compliance plan in place and ready to implement by January 1, 2014.
