Required Clearance Information

Required clearances related to PA Act 135 and IUP’s background investigation checking policy

What are the required clearances?

  1. Act 34 - Pennsylvania State Police Criminal Background Check (SP4‐164)
  2. Act 151 - Pennsylvania Child Abuse History Clearance Form (CY‐113) to determine if the person is named as a perpetrator of an indicated or founded child abuse report, and
  3. Act 114 - Federal (FBI) Fingerprint Criminal Background Check (Criminal History Report)

What is the process of obtaining clearances?

A. Existing employees, staff, student, faculty, managers, and contractors

  • All existing employees will need to obtain clearances by December 31, 2015.
  • Due to the volume of processing for Human Resources for existing employees, more announcements will follow on scheduling of appointments for each Division.
  • Please do not call, e-mail, or come to HR as a walk in to start your clearances. All appointments will be pre-scheduled through Human Resources. Your VP or dean will be contacted directly by Human Resources for assistance scheduling when your division may start the background check process.
  • IUP will cover all costs associated with obtaining existing employee clearances. 

B. If you are hiring, or are a new or existing volunteer - (age 18 or over)

  • As of July 1, 2015, new volunteers must begin the process for obtaining Pennsylvania State Police Criminal Background Check (SP4‐164) and Pennsylvania Child Abuse History Clearance Form (CY‐113) before the first day of work with IUP. Supervisors of volunteers should complete the Background Request Form to get the background process started. Volunteers can work for IUP for up to 30 days while the background checks are in progress.
  • Existing volunteers with IUP as of June 30, 2015 must obtain the Pennsylvania State Police Criminal Background Check (SP4‐164) and Pennsylvania Child Abuse History Clearance Form (CY‐113) by July 1, 2016.
  • Federal (FBI) Fingerprint Criminal Background Check (Criminal History Report) is not required for new or existing volunteers provided they have been a resident of Pennsylvania for the previous ten (10) years, the position they are applying for is unpaid, and the candidate attests to having not been convicted of a certain list of crimes in a state or territory of the United States or foreign nation (form required). All others must obtain the Federal (FBI) Fingerprint Criminal Background Check.
  • Volunteers under the age of 18 are not required to obtain any clearances.
  • Volunteers with existing clearances obtained with another institution no more than 36 months ago from start of volunteer position with IUP may send copies of those clearances to IUP-HR via e-mail at Human-Resources@iup.edu with the subject line “Existing Volunteer Clearances for Review – Volunteer First Name Last Name.”
  • Volunteer work is contingent on successful completion of all required background checks within designated time frames.
  • IUP will cover all costs associated with obtaining volunteer clearances.

C. New hires and re-hires  (staff, student, faculty, managers, and contractors)

  • New hires and re-hires must begin the process for obtaining Pennsylvania State Police Criminal Background Check (SP4‐164), Pennsylvania Child Abuse History Clearance Form (CY‐113) and Act 114 - Federal (FBI) Fingerprint Criminal Background Check (Criminal History Report) before the first day of work with IUP.  
  • Hiring managers should complete the Background Request Form to get the background process started.
  • Prior to start date, new or re-hires may work provisionally for up to 90 days provided all clearances are in progress as verified by HR.
  • HR will verify with the hiring manager/supervisor that background checks are in progress and the employee may begin working. No one can be hired or start to work until HR has verified that all clearances are in progress. 
  • Offers of employment, including student employment and graduate/teaching assistantships, are all contingent on successful completion of all required background checks within designated time frames.
  • IUP will cover all costs associated with obtaining new hire and re-hire clearances. 

For all groups: Failure to complete, show proof of completion of all required clearances, or be reported to have results which disqualify your eligibility for employment will result in the revocation of your offer of employment/volunteer position or continued employment with IUP.
